Agreement and purchases

These terms govern your use of fragrancealliancenetwork.com and your participation in Fragrance Alliance Network ("FAN") classes, recordings, consultations, and events. FAN is a d/b/a of Gustavo Design Inc. By using the site or registering for anything we offer, you agree to these terms and our Privacy Policy.

Effective date: October 1st 2025

  • Registrations are subject to our Cancelation/Refund Policy. All registrations are final unless FAN cancels or reschedules a class.
  • Gift cards are subject to our Gift Card policy.
  • Merchandise sold through our Fourthwall store is subject to Fourthwall's terms.
  • Prices and schedules may change. Class content, instructors, and materials may be adjusted as needed.
  • Eligibility: you must be 18 or older to register, or have a parent or guardian register for you and accept these terms on your behalf.

Intellectual property

The site and everything FAN provides are owned by FAN, our instructors, or our licensors, and are protected by copyright, trademark, and other laws. This includes text, photos, graphics, video, class handouts, slides, recordings, and course structure.

  • Class materials: you may use handouts and notes from a class you attend for your own learning. You may not copy, sell, publish, or share them, or teach from them, without our written permission.
  • Formulas and techniques: you may use formulas, accords, and techniques taught in class to create your own fragrances, including for sale. You may not republish or distribute the formulas themselves, or present them as FAN-endorsed, without written permission.
  • Recordings: purchased recordings are licensed to you for personal viewing only. They may not be downloaded (unless we provide a download), shared, rebroadcast, or posted elsewhere. Account or link sharing is not allowed.
  • No recording by attendees: you may not record audio or video of any class or event without the instructor's permission. Personal photos of your own work are welcome.
  • Instructor content: guest instructors keep ownership of their own materials. These terms apply to them in the same way.
  • Trademarks: "Fragrance Alliance Network," "FAN," and our logo are our trademarks. Sponsor and partner names and logos belong to their owners and appear with permission. Nothing on the site grants a license to use any trademark.
  • Third-party images: images on our site are our own, created by us, or used under license or permission from their owners. If you believe an image is used without permission, contact us as described under Copyright complaints below.

Your content

When you post a review, comment, photo, or other content, or tag FAN on social media, you keep ownership of it. You grant FAN a non-exclusive, royalty-free, worldwide license to display, reproduce, and share it on our site, social media, and promotional materials, with credit where practical. You can ask us to remove your content at any time.

By submitting content, you confirm that you own it or have permission to share it, and that it does not infringe anyone's copyright, trademark, privacy, or publicity rights. Do not upload images, text, or music you did not create or license. We may remove any content at our discretion.

We respect the rights of creators and respond promptly to copyright concerns, under the Digital Millennium Copyright Act (17 U.S.C. § 512) where it applies. If you believe material on our site infringes your copyright, please contact us first. In most cases we can review and remove material quickly.

A notice must include:

  1. Your physical or electronic signature, as the owner or someone authorized to act for the owner.
  2. Identification of the copyrighted work, or a list if several works are involved.
  3. Identification of the material you believe infringes, with enough detail for us to find it, such as its URL.
  4. Your name, address, phone number, and email.
  5. A statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act for the owner.

Counter-notice. If your content was removed and you believe it was a mistake or misidentification, send our agent a counter-notice. It must include your signature; identification of the removed material and where it appeared; a statement under penalty of perjury that you believe it was removed by mistake or misidentification; and your name, address, phone number, and consent to the jurisdiction of the federal court for your district (or, outside the U.S., any district where FAN may be found), with agreement to accept service from the person who filed the notice. We may restore the material in 10 to 14 business days unless the complainant tells us it has filed a court action.

Repeat infringers. We will remove content and end access for users who repeatedly infringe others' rights.

A false or bad-faith notice or counter-notice can create legal liability under 17 U.S.C. § 512(f).

Conduct

Please be respectful to instructors and fellow students. Do not disrupt classes, misuse the site, attempt unauthorized access, scrape content, or use the site for anything unlawful. We may remove anyone from a class or end access to our services for violating these terms, without a refund.

Working with fragrance materials

Classes involve aromatic raw materials, essential oils, and alcohol, some of which can irritate skin, eyes, or airways, or trigger allergies. Tell your instructor about any allergies, sensitivities, pregnancy, or medical conditions before class, and follow all safety instructions. You take part at your own risk.

What we teach is educational, not medical, legal, or regulatory advice. If you make, sell, or distribute fragrances, you are responsible for their safety, labeling, and compliance with IFRA standards and applicable law.

Disclaimers and liability

The site and our services are provided "as is" and "as available," without warranties of any kind, to the fullest extent the law allows. To the same extent, FAN and Gustavo Design Inc are not liable for indirect, incidental, or consequential damages. Our total liability for any claim is limited to the amount you paid us for the class or product involved. You agree to indemnify FAN for claims arising from your violation of these terms or your use of fragrances you create.

Governing law and changes

These terms are governed by the laws of the State of New York. Any dispute will be handled in the state or federal courts located in New York County, New York. We may update these terms and will post the new version here with a new effective date; continued use means you accept it.
